Kadyrov, candidate for the office of the Presidents of the Chechen Republic To the Supreme Court of the Chechen Republic, 42 Idrissov St., city of Grozny Claimant: Buraev, Shamil Doussiyevich, candidate for the office of the President of the Chechen Republic Defendant: Mr. Kadyrov, Akhmat Abdulkhamidovich, candidate for the post of the President of the Chechen Republic COMPLAINT PETITION On cancellation of the registration of Kadyrov Akhmat Abdulkhamidovich, candidate for the office of the President of the Chechen Republic Pursuant to Article 31, part 2, of the Law of the Chechen Republic "On Elections of the President of the Chechen Republic,” a candidate for the post of the President of the Chechen Republic, who has been registered by the Election Commission, is obliged to leave for vacation for the period of the election campaign and to refuse using his or her of administrative levers in implementing his or her election campaign. The said provision of the law is being roughly breached by Mr. Kadyrov, A. A., candidate for the post of the President of the Chechen Republic, and the following facts are vivid evidences of this: 1. Kadyrov A. A., Acting President of the Chechen Republic and a registered candidate for the office of the President of the Chechen Republic, is interfering into the activities of various state bodies, instructs them on decision-making, reports to the President of the Russian Federation and the Head of the Government of the Russian Federation on the decisions he is taking, including the information about the course of the election campaign. His vacation, thus, is of formal nature only. The said fact was completely confirmed by news items, which were broadcast by the ORT Federal TV Channel in their "Vremya" (Time) programme on September 11, 2003 at 9 p.m. In the first news item Kadyrov A. A. was reporting to Putin V. V., President of Russian Federation, about the measures he was taking to pay the compensations to the citizens of the Chechen Republic for their lost housing and property, and in doing so, he also expressed his judgment about his chances in the election campaign. In the second news item Kadyrov A. A., was meeting the President of the Russian Federation and the Chairman of the Government of the Russian Federation, and they were also talking about the situation in the Chechen Republic. The first news fragment was later repeated in the "Vesti-Plus" programme in the RTR "Rossiya" TV Channel. The aforesaid confirms the fact of the formal nature of the retirement of Kadyrov A. A., for his vacations, demonstrates the favorable attitude of the higher officials of the Russian Federation towards Kadyrov A. A., candidate for the office of the President of the Chechen Republic, and is nothing but pressure on the public opinion in relation to the election of the candidate and causing an effect on the course of voting. The above news fragments may remain in the consciousness of the population of the Chechen Republic, who suffered from missile and bombing attacks, as an idea that in the case they failed to elect Kadyrov A. A., to be the President of the Chechen Republic, the missile and bombing attacks would continue, moreover that such attacks are regularly taking place now in the mountain part of the Chechen Republic. Demonstrations of the loyalty of the top management of the country towards Kadyrov A. A., as to a candidate for the office of the President of the Chechen Republic and an obvious support by them of his candidature are roughly breaching the rights of other candidates for the post of the President of the Chechen Republic, and are encroaching on the equality in propaganda and election campaigning. A similar situation is observed in the mass media of the Chechen Republic, which directly calls Kadyrov A. A., the President of the Chechen Republic, although the election has not yet taken place. 2. The facts of the usage by Kadyrov A. A., candidate for the office of the President of the Chechen Republic, of his administrative levers, are also confirmed by the fact that the Government of the Chechen Republic is holding its sessions in the regions of the republic, and that it coordinates and matches them, for some reason, with the period of informing the electors and the pre-election campaign, and at each such session the ministers and other officials appeal to the voters to cast their votes for Kadyrov A. A. M. Dashoukayev, First Deputy of the Chairman of the Government of the Chechen Republic, being the head of the Chechen regional branch of the political party "Soyuz Pravykh Sil" (Union of Right Forces - SPS), covering himself with an incompetent decision of the party regional branch to support the candidature of Kadyrov A. A., together with other party members (officials of state agencies), while touring through the republic, are demanding the unconditional support of the candidate Kadyrov A. A. threatening otherwise to dismiss the heads of districts and agencies from their office. The incompetence of the decision of the regional SPS party branch lies in the fact that only the Supreme Political Council of the SPS Party is authorized to take decisions on someone's support or to recommend its regional branches to support a candidature of this or that candidate. 3. Right on the eve of the election, under the direction of Kadyrov A. A., in all district capitals so-called "security structures" were created numbering from 100 to 400 persons, which are not included in the framework of the official law-enforcement or executive bodies. These services are not maintained by the state, and their material provisioning is made at the expense of enterprises of the districts. They have their arms, technical means, all are dressed in camouflage uniform, their main aim being to demonstrate the power of Kadyrov A. A., a candidate for the office of the President of the Chechen Republic, and to exert an illegal pressure on the population during the election campaign with the purpose of compelling the electorate to vote for Kadyrov A. A., candidate for the office of the President of the Chechen Republic. I hereby ask to interrogate M. Dashoukayev as a witness, to retrieve the materials from the 'Vremya" TV programme and from the "Vesti" program TV, to interrogate witnesses, who have watched the said broadcasts. Please, ask the heads of district administrations to inform you on the presence of armed people in their districts, who are not parts of the Ministry of Interior or the FSB, and please also seek the confirmation from the said agencies. With the account of all the aforesaid, taking into account that Kadyrov A. A., candidate for the office of the President of the Chechen Republic, is roughly breaching the principles of equal opportunities in the election campaign, is using administrative levers in his election campaign, by using the officials, whom he had appointed, and also being guided by sub-item "b" of item 3 of Article 73 of the Law of the Chechen Republic "On Election of the President of the Chechen Republic" and item 2 of Article 75 of the Federal Law "On the Main Warranties of Election Rights and the Right to Participate in Referendums of Citizens of the Russian Federation,” I hereby ask: 1. For a gross violation of the Law of the Chechen Republic "On Election of the President of the Chechen Republic,” usage of his official position in holding agitation and propagation of his candidature, attraction to agitation and propaganda in favour of his candidature of the officials of state agencies and state bodies, to remove Kadyrov A.
